In order to participate in Caro Arevalo Studio LLC’s workshop, including all of its classes, online courses, the use of all e-books, e-booklets and all other constituent content and/or materials (collectively the “Workshop”) I (the “Learner”) fully understand, acknowledge and accept fully the following Terms and Conditions (hereinafter, the “Agreement”) exercising my own judgement and discretion:
- Nature of the Workshop. The information presented during the Workshop and contained within it, including ideas, suggestions, techniques, trainings, exercises, initiations, processes, activities, downloads, instructions, and other materials (collectively the “Materials”) is informative in nature and is provided only as general information for artistic development, and is not medical or psychological advice. The purpose of the Workshop is to share techniques and creative processes applied by Carolina Arevalo in her artistic practice.
- The Learner understands the Workshop is experiential in nature and is not to be considered treatment for any physical, emotional, or mental disorder. Likewise, agrees to consult with its health care providers for any specific medical, emotional, or psychological problems or issues in advance of the Workshop. Further, agrees to take full responsibility for its own self-care during the Workshop and after. The Learner further understands that its participation in the Workshop is not intended to create nor does it establish a client-practitioner relationship or any other type of therapeutic or professional relationship between the Learner and Carolina Arevalo, neither with all guest teachers which may participate, including Vivian Arias, Florencia Fridman, Koa Mikaelah, Esmeralda Zeledon, Kaitlyn Cronin, Laura Chung, Ksenia Avdulova or Roxy Caicedo (hereinafter, collectively “Guest Teachers”).
- Exercise caution. The Learner understands that the development of the Workshop involves the use of ingredients, products and plants that may be harmful to skin and body. The Learner will exercise caution while following instructions from the Workshop. In that sense, the Learner acknowledges and recognizes that the Workshop development could have inherent risks, dangers and hazards; and understands and accepts that –though unlikely– the development of the Workshop could result in injury or illness.
- Assumption of the risk. The Learner understands that its participation in the Workshop is strictly voluntary, at its own risk, and that freely chooses to participate. The Learner assumes all risk of accident or damages to its person that may be incurred from or connected in any manner with its participation in the Workshop. Specifically, but not exclusively, the Learner fully understands that the material with which will be working could cause bodily harm and assumes all responsibility for its safe use and proper physical performance. By participating in the Workshop and utilizing the Materials for such purpose, the Learner assumes and accepts full and complete responsibility for all known and unknown risks associated with its participation, the materials, the process, and the resulting products, including any physical injury, psychological or emotional effects, death, loss, or property damage.
- Release. The Learner releases Caro Arevalo Studio LLC, Carolina Arevalo and all Guest Teachers which may participate in the Workshop, from all claims, demand, actions, cause of action, and from all liability for damages, losses, or injuries that may arise from its participation in the Workshop or use of the Materials. The Learner releases Caro Arevalo Studio, LLC and all individuals connected with Caro Arevalo Studio, LLC. Specifically, the Learner and its heirs agree to fully release, indemnify, hold harmless and defend Caro Arevalo Studio LLC, Carolina Arevalo and all Guest Teachers from any and all claims or liability, and for any damage or injury, including but not limited to, financial, personal, emotional, psychological, medical, or otherwise, which the Learner may incur arising at any time as a result of its voluntary decision to participate in the Workshop. The Learner further agree to hold harmless Caro Arevalo, LLC, Carolina Arevalo and all Guest Teachers from any damages or costs, including Court and attorney’s fees, which may be incurred due to its participation in the Workshop.
- Waiver. The Learner represents that is competent and able, having at least the age of majority in its corresponding state or province of residence, to understand and agree on these Terms and Conditions and to participate in the Workshop, understanding the nature and consequences of such participation.
- Personal Information & Privacy Protection. The Learner is aware and accepts that the Workshop includes group processes (i.e. forum discussions) in which may voluntary reveal personal information (name and email address) in case decides to participate. Being that the case, by participating in such group processes, the Learner provides consent with respect to its rights of privacy and confidentiality over such personal information for such purpose. All regulations on personal information and privacy protection are contained in the Privacy Policy of the Workshop.
- Intellectual Property. The Learner acknowledges that all Intellectual Property of the Workshop is from Caro Arevalo Studio, LLC and Carolina Arevalo. In that sense, agrees and commits to only use the information and products from the Workshop and Materials for its own personal use, only. The Learner agrees that no content from the Workshop or Materials may be recorded, shared or sold without consent from Caro Arevalo Studio, LLC. The Learner understands that its prohibited from sharing with others the login information and the materials made available to me through its account. The Learner understands the Workshop contents are copyrighted materials, which I shall not duplicate, copy, reproduce, sell, rent, sub-license, redistribute or republish.
- Governing Law. This Agreement is governed by laws of the State of New York. Any and all matters in dispute between the parties in relation to this Agreement, whether arising from or relating to the Agreement itself, or arising from alleged extra-contractual facts prior to, during, or subsequent to the Agreement, including, without limitation, fraud, misrepresentation, negligence or any other alleged tort or violation of its terms and conditions, shall be governed by, construed, and enforced in accordance with the laws of State of New York, without regard to conflicts of law doctrines and regardless of the legal theory upon which such matter is asserted. If any portion of this Agreement is held to be invalid, it is agreed that the balance of the Agreement shall continue in full force and effect. This Agreement shall be binding upon the Learner, its heirs, family, legal representative, successors and assigns.
As the content of the course becomes fully available to you upon purchase Caro Arevalo Studio LLC doesn't offer refunds or exchanges.
This Agreement constitutes the entire and final agreement between the parties and supersedes any prior oral or written agreements, discussions or understandings. This Agreement may not be modified in any respect except in writing describing the modification and signed by both parties.
